These Terms & Conditions govern everything Functional Warrior provides. In these Terms, “Offerings” means any Functional Warrior course, digital product, tool, scan, self-assessment, insights report, program, download, membership, article, other content, or related material — whether paid (a “Product”) or free (“Materials”). By purchasing, accessing, or using any Offering, you (“you,” “Customer,” or “User”) agree to these Terms. If you do not agree, do not purchase, access, or use the Offerings.
The Offerings are provided by Functional Warrior for general educational and informational purposes only. They are not professional advice of any kind — medical, health, mental-health, psychological, nutritional, dietary, fitness, environmental, mold, scientific, legal, financial, or otherwise — and are not a substitute for advice, evaluation, diagnosis, or treatment from a qualified, licensed professional.
Functional Warrior is not a licensed healthcare, medical, or mental-health provider, and does not diagnose, treat, cure, or prevent any disease, illness, or condition. Functional Warrior is also not a licensed or certified physician, dietitian, nutritionist, therapist, counselor, fitness or exercise professional, laboratory, industrial hygienist, or environmental professional, and nothing in the Offerings creates a provider–patient, clinical, or other professional relationship.
Specific to mold: Functional Warrior is not a licensed or registered mold assessor, mold assessment consultant or technician, mold remediator or remediation contractor, or mold inspector, and is not licensed or registered by the Texas Department of Licensing and Regulation (TDLR) or under Chapter 1958 of the Texas Occupations Code. The Offerings do not constitute a mold assessment, inspection, survey, testing, analysis, remediation protocol, or clearance, and are not a substitute for any of these.
The scans, checklists, questionnaires, and scoring tools within the Offerings are self-directed educational instruments that you complete yourself, based on your own observations, inputs, and environment. Any scores, risk bands, levels, or interpretations they produce are educational, directional indicators only — they are not conclusive of the presence, absence, type, cause, or extent of any exposure, contaminant, deficiency, condition, or state of health; are not a professional opinion or a diagnosis; and are not prescriptive of any treatment, protocol, or corrective action. They are intended only to help you become more informed and decide your own next steps, including whether to seek qualified, licensed professionals and independent laboratory or clinical testing.
Always consult your physician or another qualified, licensed professional before making any health, medical, dietary, supplement, exercise, environmental, or financial decision, and before starting, stopping, or changing any treatment, medication, supplement, or program. Nothing in the Offerings is a recommendation or prescription to use, purchase, or discontinue any product, supplement, medication, peptide, device, or substance. Never disregard or delay seeking professional advice because of something in the Offerings. If you think you may have a medical emergency, contact your doctor or emergency services immediately.
Individual results vary and are not guaranteed. Functional Warrior makes no guarantee of any outcome, result, or benefit. You are solely responsible for evaluating the Offerings and for any decision or action you take based on them, which you do at your own risk and discretion. You assume all such risk, including any physical, health, emotional, financial, or property risk.
Some Functional Warrior tools draw, with gratitude, on the published educational frameworks of leading clinicians and researchers in the relevant field — for example, in the toxin space, the works of Dr. Neil Nathan, Dr. Ritchie Shoemaker, Dr. Joseph Brewer, and Dr. Jill Carnahan. Functional Warrior’s combined methodology, scoring, and interpretation are its own original synthesis and adaptation, and are not affiliated with, endorsed by, or a substitute for the care or proprietary instruments of any such practitioner.
Your purchase or access grants you a personal, non-exclusive, non-transferable license to use the Offerings for your own individual use. All content, tools, scoring logic, text, and materials are the intellectual property of FXW Ventures, LLC d/b/a Functional Warrior. You may not copy, redistribute, resell, share login or access credentials to, or create derivative works from the Offerings without written permission.
The Offerings may reference or link to third-party products, lab test kits, vendors, providers, or websites. These are provided for convenience and education only. Functional Warrior does not control, endorse, or guarantee any third party, is not responsible for their products, services, results, pricing, or content, and receives no fee for any decision you make with them unless expressly disclosed. Any dealings you have with a third party are solely between you and that third party.
To the maximum extent permitted by law, Functional Warrior, and its members, agents, and affiliates, shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any physical, health, bodily, property, or financial harm, arising out of or related to the Offerings, and their total aggregate liability for any claim shall not exceed the amount you paid for the applicable Product (if any).
You agree to indemnify and hold harmless Functional Warrior from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Offerings or any decision or action you take in connection with them.
All sales of paid Products are final.
Functional Warrior may update these Terms from time to time. The version posted at the time you access or use an Offering applies to that use, and your continued access or use after any update constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Texas, and any dispute shall be subject to the exclusive jurisdiction of the state and federal courts located in Texas.
By purchasing, accessing, or using any Offering, you acknowledge that you have read, understood, and agree to these Terms & Conditions, including the educational-only nature of the Offerings and the disclaimers above.
